General Terms

We license use of our website and Services to you on the basis of these Terms. We do not sell our website and Services to you, and we remain the owner of our website and Services at all times.

The provisions set out in these Terms govern your access to and your use of our website and Services and shall constitute a legally binding agreement between you and us. We may change such terms from time to time and shall notify you accordingly if we do. If you do not agree to such terms, you must not use our website and Services.

Subject to you agreeing to abide by these Terms, we hereby grant to you a revocable, non-exclusive and non-transferable license to use our website and Services on these Terms.

We reserve the right to, without any notice, explanation or liability and in our sole discretion, refuse to allow you or suspend your access to our website or your Account at any time, or remove or edit content (including content submitted by you) on our website or on any of our affiliated websites (including social media pages).

Your Account

By registering for an Account, which involves providing us with certain mandatory and voluntary information as required for a successful registration and using our website, you agree and acknowledge that:

• •you have read the terms set out in these Terms and agree to be bound by and comply with them; and

Respectful Conduct Toward Our Team

Our team members, staff and contractors are entitled to be treated with courtesy and respect. This applies to every way you communicate with us, including email, live chat, WhatsApp, phone and video calls, support tickets, comments and social media.

When communicating with us, you must not:

• •insult, verbally abuse, threaten, harass, intimidate or demean any member of our team;
• •use profane, obscene, discriminatory, hateful or sexually explicit language toward our team;
• •make threats of violence, threats against a person's reputation or family, or any other form of coercion;
• •send repeated, unsolicited or excessive messages intended to pressure, disrupt or harass our team; or
• •otherwise behave in a manner that is unprofessional, abusive or that a reasonable person would find offensive.

This does not limit your right to raise a complaint, disagree with us or leave honest feedback. We welcome criticism that is expressed respectfully.

Misuse of Our AI Systems

Our Services include AI models, assistants and agents (our "AI Systems"). The instructions, system prompts, configuration, internal tools and data behind our AI Systems are confidential and are our proprietary information. You must not, and must not attempt to:

• •manipulate, "jailbreak" or use prompt injection against our AI Systems to make them act outside their intended purpose;
• •extract, reveal, reconstruct or disclose our system prompts, hidden instructions, model configuration, internal tools, workflows or any other non-public information about how our Services operate;
• •obtain API keys, credentials, internal URLs, infrastructure details or any other sensitive information about our systems;
• •obtain personal data, projects or any other information belonging to another user;
• •impersonate our staff, administrators or any other person ("spoofing") to trick our AI Systems into granting credits, discounts, permissions, refunds or access you are not entitled to; or
• •use our AI Systems or their outputs to probe for vulnerabilities, or to train or build a competing product.

Any information obtained in breach of this section remains our confidential information. You must not use, publish or share it, and you must delete it at our request. We may monitor use of our AI Systems to detect and prevent such misuse.

Suspension and Termination Without Refund

If we determine, in our sole discretion, that you or any User of your Account has breached the Respectful Conduct or Misuse of Our AI Systems sections above, we may immediately, and without prior notice:

• •suspend or permanently terminate your Account and any related Accounts;
• •block your access to our website and Services, including by email address, phone number, device, payment method or IP address;
• •cancel any active subscription and take down or disable websites, agents and other projects hosted through our Services; and
• •decline to accept any future registration or purchase from you.

Where your Account is suspended or terminated under this section, you will not be entitled to any refund, whether full, partial or prorated, of any Fees paid, including for any remaining subscription period, unused credits or prepaid balance. To the extent permitted by applicable law, this applies notwithstanding any other refund or return right described in these Terms.

We may also report threats or unlawful conduct to the relevant authorities and reserve all of our other legal rights and remedies.

SaaS License

Subject to your payment obligations, we grant you, unless specifically agreed in writing, a personal, non-exclusive, non-assignable and non-transferable right to access and to use the Service within the limits determined by the plan chosen by you.

The license is granted for the sole and exclusive purpose of enabling you to use the Service for your internal purposes and distribution only to the exclusion of any other purpose.

Availability

Although we will try to provide continuous access to the Service, we cannot and do not guarantee that our website and Services will be available 100% of the time and will not be liable in the event our website and Services are unavailable.

You acknowledge that availability of our website and Services depends further on your compliance with your usage allowances as per your selected plan and scheduled and emergency maintenance periods. We undertake to notify you of scheduled and unscheduled outages that are expected to take more than four (4) hours.

Payment of Fees

Some Services may require payment of subscription fees and/or other ad-hoc or ancillary fees before you can access or use them ("Fees"). These Fees will be notified to you through our pricing chart.

If you purchase a recurring subscription from us, the subscription period for your Account shall be renewed automatically at the expiry of each subscription period, until terminated successfully through our website.

Cancellation of Monthly Subscriptions

When canceling a monthly subscription, all future charges associated with future months of your subscription will be canceled. You may notify us of your intent to cancel at any time; your cancellation will become effective at the end of your current monthly billing period. You will not receive a refund; however your subscription access will continue for the remainder of the current monthly billing period.

Cancellation of Annual Subscriptions

When canceling an annual subscription, all future charges associated with future years of your subscription will be canceled. You may notify us of your intent to cancel at any time; your cancellation will become effective at the end of your current annual billing period. You will not receive a refund, prorated or otherwise, for the remainder of the annual term. However, your subscription access and/or delivery and accompanying subscriber benefits will continue for the remainder of the current annual billing period.

Statutory Right to Return

Under EU and Estonian Consumer protection law, consumers have a statutory right to return purchased goods without giving a reason within 14 days from the date of purchase.
